Please read these terms and conditions carefully before using our service.
1. Introduction
Welcome to Treatss ("we," "our," or "us"). By accessing or using our mobile application, website, and services (collectively, the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, you must immediately discontinue use of the Service.
2. Service Description
Treatss is a food ordering and delivery platform that connects customers with independent restaurants and food vendors ("Vendors"). Treatss operates its own delivery network ("Treatss Delivery") to facilitate the transportation of orders from Vendors to customers. In certain cases, a Vendor may choose to fulfill delivery using its own staff or third-party delivery partners. We do not own, operate, or control any restaurants, kitchens, or food preparation facilities.
3. User Accounts
You must create an account to use certain features of the Service. You agree to provide accurate and complete information during registration, keep your login credentials confidential, and accept full responsibility for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that contain false or misleading information.
4. Orders and Payments
By placing an order through the Service, you agree to pay the total amount displayed at checkout, which may include the food cost, packaging charges, delivery fees, service fees, and applicable taxes. All prices are set by the respective Vendors and are subject to change without prior notice. Payments are processed through third-party payment service providers. Treatss does not store your full payment credentials.
Once an order is confirmed and the Vendor has begun preparation, it may not be eligible for cancellation or refund. Refund eligibility is determined on a case-by-case basis at the sole discretion of Treatss and/or the Vendor.
5. Delivery Policy
Treatss primarily handles delivery through its own delivery partners ("Treatss Delivery Partners"). However, in some instances, restaurants may fulfill delivery using their own staff or independently contracted delivery services. The method of delivery for any given order is determined based on availability, location, and Vendor preference.
While Treatss strives to ensure timely and safe delivery, we cannot guarantee specific delivery times. Estimated delivery times displayed on the platform are approximations and may vary due to traffic, weather, order volume, or other unforeseen circumstances. Treatss shall not be liable for delays, spoilage, or damage to items that occur during transit, whether the delivery is handled by Treatss Delivery Partners or the Vendor's own delivery personnel.
6. Food Images and Descriptions Disclaimer
Images of food items, menu photographs, and other visual content displayed on the Service are for illustrative and representational purposes only. Some images may be sourced from the internet, stock photography, or provided by Vendors. The actual appearance, portion size, plating, garnish, and presentation of food delivered to you may differ from what is shown on the platform. Treatss does not guarantee that the food received will match the images displayed.
Menu descriptions, ingredient lists, allergen information, and nutritional details (if any) are provided by the respective Vendors and are not independently verified by Treatss. Customers with food allergies or dietary restrictions are strongly advised to contact the Vendor directly before placing an order.
7. Vendor (Restaurant) Terms
Restaurants and food Vendors listed on Treatss are independent businesses and are not employees, agents, or affiliates of Treatss. By partnering with Treatss, Vendors agree that:
- They are solely responsible for compliance with all applicable food safety, hygiene, labor, tax, and local licensing laws and regulations.
- They are responsible for the quality, accuracy, and timely preparation of all orders.
- When a Vendor chooses to use its own delivery, the Vendor assumes full responsibility for the delivery process.
- They are responsible for the accuracy of menu items, descriptions, pricing, images, and allergen information listed on the platform.
- Treatss is not liable for customer complaints, health issues, refund requests, or order errors arising from the Vendor's food preparation or operations.
Vendors agree to indemnify and hold Treatss, its officers, employees, and agents harmless against any legal claims, disputes, damages, losses, or regulatory actions arising from their operations, products, or services.
Treatss reserves the right to suspend, delist, or permanently remove any Vendor from the platform at any time, without prior notice, for reasons including but not limited to: reports of poor food quality, unhygienic practices, food safety violations, customer complaints, failure to meet platform standards, fraudulent activity, non-compliance with applicable laws, or any conduct that Treatss determines, at its sole discretion, to be harmful to customers, the platform, or the Treatss brand. No compensation shall be owed to a Vendor upon such removal.
8. User Conduct
You agree not to misuse the platform, engage in fraudulent activity, submit false reviews or ratings, or harass Vendors, delivery partners, or Treatss staff. You shall not use the Service for any unlawful purpose or in any manner that could damage, disable, or impair the Service. Treatss reserves the right to suspend, restrict, or permanently delete accounts for violating these Terms, our community standards, or applicable laws.
9. Intellectual Property
All content, branding, logos, designs, software, and features of the Treatss platform are owned by Treatss or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the platform without our express written permission.
10. Limitation of Liability
To the fullest extent permitted by applicable law, Treatss is not responsible for:
- Food quality, safety, hygiene, or allergen-related issues, as all food is prepared by independent Vendors
- Illness, allergic reactions, or health problems resulting from consuming food ordered through the Service
- Delivery delays, spoilage, spillage, or damage during transit
- Accidents, theft, injury, or property damage occurring during the delivery process
- Disputes between customers, Vendors, or delivery partners
- Discrepancies between food images or descriptions on the platform and the actual food delivered
- Inaccurate menu information, pricing errors, or unavailability of items
In no event shall Treatss, its directors, officers, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.
11. Refunds and Cancellations
Refund and cancellation policies may vary depending on the Vendor and the stage of order preparation. Treatss may, at its sole discretion, issue partial or full refunds in cases of verifiable delivery failures, missing items, or significant quality issues. All refund decisions are final. Repeated abuse of refund requests may result in account suspension.
12. Termination
Treatss may terminate or suspend your account at any time, without prior notice, for conduct that we believe violates these Terms, is harmful to other users, Vendors, delivery partners, or the platform, or for any other reason at our sole discretion.
13. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated through the platform or via email. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms. It is your responsibility to review these Terms periodically.
14. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of Nepal. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Nepal. The parties agree to attempt to resolve any disputes through good-faith negotiation before resorting to formal legal proceedings.
15. Disclaimer and Legal Separation
Treatss operates as a technology platform that facilitates food ordering and delivery logistics. While Treatss operates its own delivery network, it does not own, operate, manage, or control any restaurants, kitchens, or food preparation facilities.
By using our platform, you understand and agree that:
- Treatss is not responsible for food preparation, food safety, hygiene standards, or the quality of food served by Vendors.
- While Treatss manages delivery for the majority of orders, some deliveries may be handled by the Vendor's own staff or third-party services. Treatss makes reasonable efforts to ensure safe delivery but cannot guarantee against all delivery-related incidents.
- Food images and descriptions on the platform are for representational purposes only and may not reflect the exact appearance, portion, or presentation of the food delivered.
- Treatss is not a food manufacturer, restaurant, or catering service and bears no liability for the products prepared and sold by Vendors.
- Any complaints regarding food quality must be directed to the respective Vendor. Delivery-related complaints may be reported to Treatss for review.
You agree to indemnify, defend, and hold harmless Treatss, its founders, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from your use of the Service, violation of these Terms, or interactions with Vendors and delivery partners.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Treatss regarding the use of the Service and supersede all prior agreements and understandings.
